BOROUGH OF FANWOOD
RESOLUTION 01-06-91
WHEREAS, on October 12, 2000, the Mayor and Council of the Borough of Fanwood adopted Resolution No. 00-10-144 authorizing the Planning Board of the Borough of Fanwood to undertake a preliminary investigation to determine whether the area of Fanwood bounded by Martine Avenue, South Avenue, La Grande Avenue and Second Street, or any part thereof, meets the criteria set forth in N.J.S.A. 40A:12A-5 as an area in need of redevelopment; and
WHEREAS, in connection with the investigation conducted by the Planning Board, the Borough retained the services of Richard Preiss of the planning firm of Abeles Phillips Preiss & Shapiro to review the designated area and evaluate whether it or any part thereof met the statutory criteria of an area in need of redevelopment; and
WHEREAS, the Planning Board, through the service of Mr. Preiss, prepared a map of the designated area (hereinafter "the Map"); and
WHEREAS, the Planning Board, as required by statute, provided due notice of a hearing and did hold a hearing on May 16, 2001 in order to determine whether the designated area met the statutory criteria of an area in need of redevelopment; and
WHEREAS, at the hearing before the Planning Board, Mr. Preiss presented his report entitled "Redevelopment Area Study for the Block Bounded by South Avenue, Martine Avenue, LaGrande Avenue and Second Street in the Borough of Fanwood, New Jersey" dated March 2001 (hereinafter "the Report"); and
WHEREAS, at the hearing members of the public were afforded the opportunity to be heard and did address the Planning Board with comments; and
WHEREAS, the Planning Board approved a resolution by a vote of 6-0, recommending that the entire designated area should be determined by the Mayor and Council to be an area in need of redevelopment, i.e. a redevelopment area; and
WHEREAS, the Mayor and Council have reviewed the Report, as well as the resolution of the Planning Board, and the comments of the public, and the Mayor and Council have considered the criteria set forth in N.J.S.A. 40A:12A-5 for determining an area to be in need of redevelopment.
NOW, THEREFORE, BE IT RESOLVED, for the reasons set forth in the Resolution of the Planning Board dated May 23, 2001, which is attached hereto and incorporated herein by reference, and for the reasons set forth in the report entitled "Redevelopment Area Study for the Block Bounded by South Avenue, Martine Avenue, LaGrande Avenue and Second Street in the Borough of Fanwood, New Jersey" dated March 2001, which is incorporated herein by reference, the Mayor and Council of the Borough of Fanwood do hereby determine that the entire area bounded by Martine Avenue, South Avenue, LaGrande Avenue and Second Street and set forth on the Map is an area in need of redevelopment, i.e., a redevelopment area, pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq.
