Re: Downtown Redevelopment Plan - Prepared by Abeles Phillips Preiss & Shapiro Inc.

At the Planning Board's agenda meeting on December 17, 2001
they held a public hearing on the above plan.

Mr. Whitaker/Mayor Jung moved to accept the plan with the
14 modifications that were suggested by the board members.

Ayes: Joel Whitaker, Mayor Jung, Nancy Koederitz, John Celardo, Gregory Cummings, John Gurley, Eric Hess

Nays: Jack Molenaar, Andrew MacDonald

The motion carried 7 to 2.

Mr. Joseph Ferrucci from Abeles Phillips Preiss & Shapiro
Inc. typed up the 14 modifications for clarification (copy
attached). These modifications were reviewed again by the
Planning Board at their December 26, 2001 meeting and two
items were reworded as follows:


1. Adequate parking must be provided for all uses fronting
on South avenue. This parking should be provided to the
rear of those uses.

10. The Redevelopment Plan should include a clause
that requires the residential and commercial parts of the
Redevelopment Area to be developed with requirements
ensuring that the existing commercial district is not
developed in a manner secondary to the residential development.

Mr. Whitaker/Ms. Koederitz moved to accept these changes.

The motion carried unanimously.

Remarks: While I was out of the office over the last few days,
Councilman Joel Whitaker left me a message with one
additional change to the memo with the Planning Board's
recommended changes to the redevelopment plan. This
change involved the addition of a sentence to Item # 6
regarding tree replacement on the redevelopment site. The
revised memo is attached.

Memorandum

To: Council of the Borough of Fanwood

Re: Redevelopment Plan for downtown Fanwood

Date: December 18, 2001

At the Planning Board meeting of December 17th the Planning Board passed a motion
to approve the Redevelopment Plan for the Block Bounded by South Avenue, Martine
Avenue, LaGrande Avenue, and Second Street in the Borough of Fanwood, New Jersey,
dated November 2001, with the following changes and recommendations:

1. Adequate parking must he provided for all uses fronting on South Avenue. This
parking should be provided to the rear of those uses, and it must be set aside for the
exclusive use of those uses.

2. Senior housing should be considered as part of the mix of housing built within the
redevelopment area

3. Under Section V, paragraph (F) of the Redevelopment Plan, the word "forty (40)"
should be replaced with the word "twelve (12)". The revised paragraph should read
"The provisions of this plan specifying the redevelopment of the Redevelopment
Area and the requirements and restrictions with respect thereto shall be in effect for
a period of twelve (12) years from the date of approval of this plan by the Council of
the Borough of Fanwood."

4. The Redevelopment Plan should incorporate language From the Borough zoning
code stating it is the public policy of the Borough of Fanwood that on-site parking be
provided to the maximum extent possible.

5. The diversity of retail establishments within the Redevelopment Area should be
encouraged.

6. All existing trees within the Redevelopment Area should be preserved to the
maximum extent possible. After redevelopment, the resulting trees on the site shall
be equal to or greater in number than the existing trees, and the quality of the trees
shall be equal to or better in quality than the existing trees. Consultation with the
Shade Tree Commission should be required for ail site plan approvals.

7. The Borough Health Officer should be consulted with regard to potential impacts of
the Redevelopment Plan on businesses subject to health regulation for food storage,
preparation, or sale.

8. Any redevelopment agreement between the Borough and a private developer should
stipulate that the developer must maintain existing rent levels for existing businesses
located in the Redevelopment Area, whether or not they move From one space to
another, with phased increases permitted over time.

9. The Council should consult with a financial advisor to assess the potential impact of
the Redevelopment Plan on impact on the borough.

10. The Redevelopment Plan should include a clause that requires the residential and
commercial parts of the Redevelopment Area to be developed within a reasonable
time period of one another.

11. Any redevelopment agreement between the Borough and a private developer should
require the developer to engage in marketing activities to promote commercial
investment and development in the Redevelopment Area

12. The Mayor should appoint a "Blue Ribbon" panel of landowners, business owners,
and other stakeholders to assist the Council in preparing a Request for Qualifications
and a Request for Proposals for the redevelopment of the site.

13. The Downtown Revitalization Coordinator should consult with all property owners
and business owners in the Redevelopment Area to identify their concerns. The
Coordinator shall prepare a written summary of those concerns.

14. Under Section III, paragraph (B)(4)(f), the word "five (5)" shall be replaced with the
word "seven (7)", and the word "ten (10) shall be replaced with the word "fifteen (15)
." The revised paragraph should read "The yard setback between a residential
building and a street shall be a minimum of seven (7) feet and a maximum of fifteen
(15) feet."
