RESOLUTION OF THE PLANNING BOARD
OF THE BOROUGH OF FANWOOD RECOMMENDING APPROVAL
OF THE REDEVELOPMENT PLAN FOR BLOCK BOUNDED BY SOUTH AVENUE,
MARTINE AVENUE, LaGRANDE AVENUE AND SECOND STREET
WHEREAS, pursuant to a resolution approved on May 23, 2001, the Fanwood
Planning Board recommended to the Borough Council that the area bounded by South
Avenue, Martine Avenue, LaGrande Avenue and Second Street, be designated as an
area in need of redevelopment pursuant to the provisions of the Redevelopment and
Housing Law, N.J.S.A. 40A: 12A-1 et seq. (the Act"); and
WHEREAS' pursuant to Resolution 01 06-91, the Borough Council designated
the area bounded by South Avenue, Martine Avenue, LaGrande Avenue and Second
Street (the "redevelopment area") as an area in need of redevelopment pursuant to the
Act; and
WHEREAS, the Borough Council authorized the preparation of the
Redevelopment Plan, a copy of which is attached hereto as Exhibit A and entitled
"Redevelopment Plan for Block Bounded by South Avenue. Martine Avenue, LaGrande
Avenue and Second Street in the Borough of Fanwood, New Jersey' and dated
January 2002 (the "Redevelopment Plan"); and
WHEREAS, pursuant to the Act, the Redevelopment Plan and Ordinance 02-01-R
were referred to the Planning Board with the request that it transmit to the Mayor
and Council within 45 days a report containing its recommendations concerning the
Redevelopment Plan and include in its report an identification of any provisions in the
proposed redevelopment plan which are inconsistent with the master plan and
recommendations concerning these inconsistencies and any other matters as the board
deems appropriate; and
WHEREAS, the Planning Board reviewed the Redevelopment Plan and solicited
and received public comment at a meeting held on January 23, 2002;.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Board of the Borough
of Fanwood, New Jersey as follows:
1. The Redevelopment Plan is hereby recommended for adoption by the Mayor
and Council subject to the following suggested amendments:
a) Section III(B)(4)(f) regarding yard setback requirements should be amended
by adding for the sake of clarity the following sentence: "When the front lot line is along
a roadway, the term "front lot line" means "right of way".
b) Section IV(F) of the Redevelopment Plan should be amended to state:
"Except as provided in this Redevelopment Plan, the provisions of the Code of the
Borough of Fanwood relating to Preservation and Removal of Trees" (Chapter 93,
Section 11.16) shall govern the removal and replacement of trees."
2. The Redevelopment Plan departs to some extent from the Master Plan where
the CC District is described in the Master Plan as a district which is (i) entirely
developed and (ii) one in which restaurants should not be permitted. These minor
inconsistencies are noted in the Redevelopment Plan in Section II(A) and are well
justified in the Redevelopment Plan. No recommendations are therefore necessary
concerning these inconsistencies.
3. A copy of this Resolution with the attached Exhibit be transmitted to the
Borough Council of the Borough of Fanwood, New Jersey.
I hereby certify that the above Resolution was duly adopted by the Planning
Board of the Borough of Fanwood at its meeting on February 18, 2002.
